The legal industry, a profession steeped in tradition and precedent, is undergoing a technological revolution driven by generative AI. This technology promises to reshape the legal services landscape, offering unprecedented efficiency gains in tasks such as document review, legal research, and contract analysis.

Navigating cultural and structural barriers

At Futurice, we partner with numerous organisations across a wide range of industries to help them capitalise on the opportunities that Generative AI brings. The legal industry has one of the highest potentials as a result of this technology, but at the same time, it is grappling with some of the biggest challenges in realising that potential.

The very fabric of the legal profession, its culture, career structures, and reward systems, presents significant barriers to the adoption of such a disruptive force. These traditional norms have collectively fostered a 'fixed mindset', where abilities are viewed as static and failure is heavily penalised, a culture that is in direct opposition to the 'growth mindset' required for successful technological innovation.

To navigate this transformation, firms must implement a multi-faceted strategy that redefines how they measure success, mentor talent, and implement sophisticated capability training programmes.

This article analyses the prevailing cultural and structural norms within the legal industry, particularly concerning career progression and reward. It compares these established norms with the behaviours and cultural attributes we have seen successful in supporting the adoption of generative AI in other sectors. By highlighting the inherent conflicts, we uncover why adoption is challenging for law firms and, most importantly, what they can do about it.

The traditional legal career: A culture of perfection and a 'Fixed mindset'

The career path in a traditional law firm is often a steep, hierarchical climb, culminating in the coveted position of partner. This journey is governed by a deeply ingrained set of cultural and structural norms that have defined the profession for decades and created a fertile ground for a 'fixed mindset'.

The path to partnership: The 'Pyramid of perfection'

The dominant structure in most law firms is a rigid 'pyramid of perfection', with a broad base of junior associates performing routine tasks, a smaller number of senior associates, and a select few partners at the apex. This structure is inherently designed for risk-averse excellence, where work is passed up a chain of command for checking and rechecking at each level. Career progression often follows an 'up-or-out' model, where associates who do not advance to the next level are expected to leave. This creates an environment of constant evaluation, where associates feel they must repeatedly prove their intelligence to advance. The primary metrics for advancement are notoriously centred on two key areas:

  • Billable hours: The cornerstone of the traditional law firm's business model. Associates are expected to meticulously track their time in six-minute increments, as hours billed to clients directly translate to firm revenue. This constant quantification of time can lead to an externalisation of self-worth and incentivise long hours over efficiency, leaving little time for non-billable development activities.
  • Client origination: For senior lawyers, the ability to bring in new business is a critical factor for making partner, emphasising individual rainmaking skills over collaborative innovation.

Rewarded behaviours: Risk aversion and individual expertise

The culture within law firms is designed to minimise risk and ensure perfection, which can foster a 'Culture of Genius' where talent is seen as a fixed, innate quality. This is understandable given the high stakes of legal work, but it is toxic for innovation. The behaviours that are consistently rewarded reflect this ethos:

  • Meticulousness and precedent: Lawyers are trained to be detail-oriented and to rely heavily on established legal precedent. This reliance on the past, while essential for legal stability, can stifle creativity and a willingness to challenge established norms.
  • Perfectionism and fear of failure: The profession demands a high degree of accuracy, which can morph into a maladaptive perfectionism where any mistake is viewed as a personal failure. This creates a 'culture of fear', especially for junior lawyers who are terrified of making mistakes, as the penalty for error is perceived as far greater than any reward for innovation.
  • Hierarchical apprenticeship: The traditional apprenticeship model involves junior lawyers drafting documents that are then corrected by senior lawyers, with feedback focusing on final correctness rather than the reasoning process. This 'checker' model reinforces gatekeeping, centralises decision-making, and stifles the independent, experimental thinking required for AI adoption.

The prevailing culture: A 'Fixed mindset' resistant to change

The combination of the partnership structure, the billable hour, and the emphasis on risk aversion has created a culture that is often conservative and resistant to change. This environment cultivates a 'fixed mindset', in which individuals believe their intelligence is fixed and shy away from challenges to avoid failure. This begins in law school, where certain teaching methods and grading curves can instill a fear of being wrong. Innovation, especially when it threatens to disrupt the profitable billable hour model, is often met with scepticism and financial disincentives.

The culture of successful Generative AI adoption: The 'Growth mindset'

In stark contrast to the traditional legal culture, the environments where generative AI has been successfully adopted are characterised by a 'growth mindset', the belief that abilities can be cultivated through dedication and hard work. These are cultures built for speed, learning, and collaboration.

Key behaviours for success: Agility and collaboration

  • Experimentation and iteration: Successful AI adoption requires a 'fail fast, learn fast' mentality. Teams are encouraged to experiment with new tools and processes in short, iterative cycles, learning from what doesn't work as much as from what does. This involves creating controlled, low-stakes 'sandboxes' or pilot projects where teams can prototype AI use cases without fear of negative consequences for imperfect results. The process moves rapidly from proofs-of-concept (PoCs) to minimum viable products (MVPs) and then to production.
  • Collaboration and cross-functional teams: AI implementation is not just a technology project; it requires the combined expertise of domain experts (lawyers), technologists, data scientists, and compliance staff. Success depends on small, empowered, cross-functional teams that can work outside of traditional hierarchies to break down organisational silos.
  • Data-driven decision making: Rather than relying solely on precedent or gut feeling, an AI-driven culture uses data to inform decisions and measure outcomes. A successful AI programme is underpinned by a clear strategy with defined objectives and key performance indicators (KPIs).
  • Knowledge sharing and transparency: The focus shifts from individual expertise to collective intelligence. Sharing data, insights, and learnings across the organisation is crucial for training AI models and scaling their benefits. Openly communicating the AI strategy, including its limitations, builds trust and a sense of ownership among employees.

Supportive cultural elements: Psychological safety and continuous learning

  • Psychological safety: To foster experimentation, it is essential to create an environment where employees feel safe to try new things, voice opinions, ask questions, and even fail without fear of punishment. Psychological safety is the 'bedrock' of a high-performing team and is vital for successful AI adoption. Leaders must cultivate this by actively inviting input, responding productively to concerns, reframing mistakes as learning opportunities, and visibly sharing their own failures.
  • Continuous learning and a growth mindset: The rapid evolution of AI means that skills can quickly become outdated. A culture of continuous learning is vital, where challenges are seen as opportunities for development. This includes upskilling and reskilling employees in AI fluency, critical thinking, and 'metaskills' like cognitive agility and resilience.
  • Agile and flexible structures: Rigid, hierarchical structures are too slow to keep pace with technological change. Successful organisations adopt more agile and flexible operating models, such as a hybrid model with a central AI 'Centre of Excellence' supporting embedded business unit squads or a 'Team of Teams' model with an orchestration team and autonomous MVP teams.

The very structures and incentives that have made law firms successful are now the biggest impediments to their future transformation.

Bridging the divide: A blueprint for an AI-first law firm

The challenge of adopting generative AI is not primarily a technological one; it is a leadership and cultural change challenge. For law firms to successfully navigate this transition, they must be willing to fundamentally rethink their operating models and actively cultivate a growth mindset.

These are the four main areas we believe need to be addressed.

1. Implement an Agile governance framework

Traditional, slow-moving governance is toxic for innovation. Firms must pair governance with speed by creating a framework that enables rapid experimentation while managing risk. The first task is often to establish a Central Task Force, a dedicated, cross-functional AI task force or 'catalyst collective' with representation from legal, technology, security, risk management, and new legal technologist roles. This group's responsibilities include developing AI policies and guardrails, setting up sandbox environments, educating the firm, vetting tools, and overseeing the firm's overall AI strategy. Some forward-thinking firms have already established such bodies. This group can then define risk appetite using a tiered system to classify AI use cases, avoiding a one-size-fits-all policy that kills momentum. A 'traffic light' system is a practical approach:

  • High-risk / Red light (Prohibited/Strict oversight): Activities directly impacting client legal matters, like legal research for briefs or using AI for autonomous decision-making. These require rigorous human-in-the-loop verification and potentially client consent.
  • Medium-Rrsk / Yellow light (Elevated oversight): Internal efficiency tasks like drafting initial documents or summarising depositions, which require department head approval and a documented risk assessment.
  • Low-risk / Green light (Standard precautions): Administrative tasks like generating marketing content or internal communications, which can be pre-approved within safe boundaries.

It is essential that they then implement a rapid approval process, replacing slow, bureaucratic reviews with a lightweight governance forum that meets regularly to approve experiments and monitor risk. This allows for time-boxed sprints (e.g., 2-4 weeks) with clear hypotheses, enabling teams to iterate quickly on high-value pilots.

2. Redefine people, teams, and roles

As you move from PoC to production scaling it is time to consider how you evolve the Talent Model from 'Pyramid' to something more like a 'Diamond'. As AI automates routine junior tasks, the traditional 'pyramid' structure potentially becomes obsolete. Firms must transition to a model with a leaner junior cohort, a broader mid-level of experienced lawyers and specialists, and a strategic leadership tier.

Within this new model, a narrow legal-centric framework is replaced with new roles and career paths. Firms must formalise new roles and create clear career paths to demonstrate to a broader set of professionals that they have a future at the firm.

  • Legal technologists/engineers: These professionals bridge the gap between law and technology, implementing tools and designing efficient workflows.
  • Prompt engineers: This is an emerging critical skill, whether as a dedicated role or a core competency for all lawyers, focused on crafting effective instructions to guide AI outputs.
  • Hybrid 'half-tech' roles: Positions like Service Owners, Agile Coaches, and Product Managers are needed to translate legal needs into scalable AI services.

As a result in the change in work and the role AI can play in ‘doing’ a lot of what Juniors previously did we see Juniors becoming 'Builders and Evaluators': The role of the junior lawyer must shift from manual work to higher-value tasks. Their responsibilities should be updated to include prompt design, critical evaluation of AI outputs, and hypothesis-driven prototyping in safe 'sandbox' environments. They become 'insight archaeologists' who use AI to unearth strategic angles.

As part of organisational design we create Cross-Functional Squads: For any AI initiative, assemble small, dedicated, multidisciplinary teams that pair lawyers with technologists, data scientists, and operations staff. Allow these 'squads' to operate outside the normal hierarchy to accelerate progress and learning.

3. Lead the cultural shift: Coaching and training

This type of fundamental cultural change requires visible championing from the Top: Digital transformation requires senior leaders who articulate a clear AI strategy, model its use and expected behaviours and consistently communicate its importance to the firm's future.

Senior lawyers must evolve from simply correcting final outputs to coaching their teams on higher-level skills. This means teaching the reasoning process, risk tolerance, and how to spot patterns and make judgement calls.

  • Focus on the 'why': Instead of just line-editing, seniors should engage juniors in a Socratic dialogue about the AI's output, asking questions like, 'What prompts did you use?', 'What are the potential weaknesses or biases in this output?', and 'How did you verify this information?'.
  • Model critical evaluation: Seniors can model responsible AI use by demonstrating how they craft precise prompts, test assumptions, and critically analyse AI-generated content for inaccuracies and missing nuances.
  • Use comparative reviews: A senior can generate a draft with an LLM and review it side-by-side with a junior's draft, turning the AI into a 'neutral third voice' to spark targeted discussions about strengths and gaps.
  • Delegate higher-value work: With AI handling first drafts, seniors can delegate more strategic tasks to juniors, such as developing case strategy and participating in client meetings, moving them 'upstream' in the value chain earlier in their careers.
  • Prioritise foundational skills: It is crucial that juniors first learn the fundamentals of legal writing and analysis themselves before relying on AI, so the technology becomes a tool, not a crutch.

At the same time as coaching Senior leaders must foster Psychological Safety, creating spaces where trial and error are accepted as part of the innovation process. This is achieved by creating 'safe sandboxes' with synthetic or redacted data for experimentation, encouraging open dialogue about fears surrounding AI, and celebrating early adopters and learning from mistakes.

Within this space we then create advanced training programmes to build the skills needed for success:

  • Design a prompt engineering curriculum: Develop a tiered curriculum that covers foundational LLM knowledge, ethical guardrails, and practical, hands-on exercises for crafting and refining prompts. Training should be tailored to specific practice areas. Firms can create best-practice prompt guides and teach techniques such as breaking complex questions into a chain of simpler prompts.
  • Embrace reverse mentoring: Given that junior lawyers often use AI more than senior partners do, firms should launch formal reverse mentoring programmes in which tech-savvy juniors help senior colleagues adapt to new tools. Some leading firms have already implemented such programmes.
  • Use AI as a training tool: AI itself can be used for immersive training.
    • AI as a 'Socratic partner': Use AI to create interactive dialogues that challenge a lawyer's assumptions about a case or text, helping them find logical holes in their arguments.
    • AI-powered simulations: Create realistic, dynamic simulations for negotiation, deposition, or court arguments, where the AI plays the role of opposing counsel or a judge, providing a safe environment to practise high-stakes skills.
    • Gamification: Incorporate elements like leaderboards and badges to encourage engagement with training.

4. Fix the incentive problem: Metrics and compensation

Finally we get to the most difficult but crucial step, Moving Beyond the Billable Hour. The efficiency gains from AI directly challenge the billable hour model. Firms must explore Alternative Fee Arrangements (AFAs) that align the firm's success with the efficiency and value AI provides. Models include value-based billing, fixed fees, subscriptions, and outcome-based fees. Some firms also consider adding a 'tech fee' to pricing to make the value of technology explicit.

Although the billable hour isn’t going away any time soon, alongside it can sit new metrics for Innovation: To reward what matters, firms must measure it.

  • Track innovation KPIs: Measure project-based milestones, the number of new ideas in the innovation pipeline, and adoption rates of new tools.
  • Quantify efficiency and value: Track metrics such as the percentage of time saved on tasks (for example, one firm found that AI made client briefings significantly quicker), reductions in review cycles, margin uplift per partner hour, and ROI on AI pilots.
  • Focus on client-centric metrics: Shift focus to external measures like Net Promoter Scores (NPS) and client satisfaction ratings.
  • Use a 'Vitality index': Consider metrics from other industries, such as the percentage of revenue derived from new services introduced over the last three years.

With this change comes the need to overhaul compensation and performance reviews to reward, incentivise and embed the behaviour change needed:

  • Reward innovation directly: Allocate 'billable credit' for non-billable innovation work, as some innovative firms do. Institute merit-based bonuses, profit sharing, or even equity for contributions to successful innovation projects.
  • Adopt holistic and hybrid models: Move to compensation models that recognise a broader spectrum of contributions, including innovation, mentoring, and leadership. This can be structured based on seniority, with juniors receiving 'citizenship' bonuses and seniors receiving mentoring bonuses.
  • Update performance reviews: Performance reviews must include a dedicated section on innovation and technology. Update competency models to include skills like prompt design and output evaluation. Use 360-degree feedback to get a holistic view of an individual's collaborative and innovative efforts. The framework must explicitly reward documented learning and experimentation, not just billable throughput.
